Application / Regulation advice If push comes to shove - destruction question

I have absolutely no intention of forfeiting my working AR15 to the state.

That being said, if it comes down to the wire and they start leaning on us even harder as October 30 approaches, are they expecting to steal intact, working rifles?

Because I have a chop saw, and will cut my rifle into pieces and bring the scraps in a bag to the cop shop. Because fuck ’em is why.

Being the dickhead statists they are, you would probably have to make sure that the scraps have a “trigger lock” and are enclosed in a locked hard sided container.

Any thoughts?

Your only obligation is to report the destruction of a restricted firearm in a timely manner. Once the firearm is destroyed, it no longer needs a trigger lock as it's no longer a firearm. You are not obligated to deliver it anywhere, as it's no longer a firearm.

The biggest issue is if you do report it destroyed, make sure its actually destroyed, because if some reason they take it upon themselves to verify it, you are now in way more trouble than if you just refused to comply.

I don't think i would chop one up and then toss it scrap bin, I would probably keep at least enough if it to verify that it had been destroyed should they decide (whether they have the jurisdiction or not) to come looking for it.

Obviously you should talk to a firearms lawyer, but you're not obligated to prove or keep anything. Report it in a timely manner that it was destroyed prior to the end of the amnesty and that's that.

In a court proceeding, it is the Crown that has to prove it wasn't destroyed. However, avoiding court proceedings has its own advantages.

Oh im not concerned. Taking it to the gun Smith defeats the purpose. Destroying it on your own mean you are free from legal burden but the government can never actually be certain that gun (with out actually physically verifying it) is destroyed, and im just petty like that

Thanks! I guess I need to consult some professionals near the end of the amnesty. My goal was to be able to use it as dry fire platform for those laser cartridges. Might not be possible.

Yes there is a set of instructions somewhere on the government of Canada website on what constitutes a deactivated firearm.  IIRC, you have to weld a plug in the chamber so you cannot chamber a round, you must either cut the bolt in half or weld up the face so the bold cannot hold a round, and you must disable the fire control group by welding it up or cutting it up so the hammer cant drop when you pull the trigger.  There may be other stipulations,  but that's what I recall.

I have a Smith and Wesson FPC. The reciever is essentially a buffer tube with a serial number. If I cut it in half, I'd never be able to cycle the action but I could place a round in the chamber then stick the bolt in I think. I guess the bolt would shoot out the back with the receiver chopped but the gun would still fire. Does destroying the firearm require making it unable to fire or can I simply fuck up the reciever and call it deactivated?

There are very specific requirements for a firearm to be considered deactivated. I don't have it right in front of me (google it), but you need to drill the chamber, and weld a rod down the barrel, and weld the bolt shut. Might be more required as well.

Doesn't the legislation just say I needs to be reported to a peace officer? I wonder what happens if you call your local police, report it to a cop and record the call. It's nothing they want to deal with but I believe you have satisfied the law.

It’s coming down to who blinks first and I think it’ll be the government.

They still have method to even collect the damn things and the entire country has now distanced itself from this program and want out.

They don’t give two craps about making 2 millions people criminals, they will do it, then track down and prosecute a handful of higher profile people and know that that will be enough to get the majority to comply

I mean sure, possible. But this country can’t even track violent criminals that are up for deportation, 10,000 are now classified as missing.

We can’t even put murderers and rapists in prison. Murders are actually getting cases thrown out due to how back logged the courts are.

One dude who was convicted of rape in Ontario had his sentence thrown out because his sentencing hearing was delayed more than 2 years.

For the LPC to say “we’ve now decided every court in Canada will now shut down to only target law abiding gun owners” not sure that will go well.

Remember they’ll also have to arrest half the police and military too.

Remember, for those to be deported, they are actual criminals. Gun owners aren't.

Second, as far as court goes, and procedure and sentencing.. It's not the risk of jail time that'll kill ya.. It's the $30-100k lawyer bill. And with federal court charges taking roughly 3 years to work their way through court, that's a long time for your life to be turned upside down. Jobs will be lost, marriages broken..

Yeah, Ian Runkle, CCFR and I think soapboxguns have all said that repeatedly. Do not lie and report the firearms as destroyed. Do not falsely claim they "fell in the lake".

Personally, I'd like to see a test case where someone used "civil disobedience of an unjust law" as a defense. The idea being to test whether civil disobedience is a protected form of freedom of expression and whether the people retain the right to defy abusive legislation.

But obviously anyone trying this is taking a big risk. So I don't think it's going to happen.

Problem is, the ones owners are going to be destroying are newly Prohibited. And Prohib destruction definitely needs to be reported.

Which brings us to a grey area: NR and R can be destroyed by the owner. But machine guns and other legitimate Prohibited firearms need to be destroyed to a high degree (chopped receiver, welded trigger mechanism etc) and by a licensed gunsmith.

So is the CFP going to allow us to self report destruction?

Because I believe it has been said it has to be destroyed by a registered gunsmith to destroy it and verify its destruction.

I don't recall destruction being defined at all in the legislation or regulations the way deactivation is. The liberals and RCMP are trying to make it sound like you need to have this done by a gunsmith but I don't think there's actually any legal requirement to do so. Which makes sense because there are many ways in which a gun could be accidentally destroyed.

Call the non-emergency line for pickup. If they don’t show up, call again the next day, document the time of your call and who you spoke to. Your duty ends at reporting destruction to a peace officer, do not waste a minute of your time dropping it off to them.

I’ve seen some firearm collectors in Europe had been able to scoop up previously 2k+ firearms for less than 500 from auctions here in Canada because the ban had essentially rendered them worthless on Canadian market.

Parting everything out minus the serialized reciever/lower/frame is a option especially on the prohibited/restricted/ar/ ect There is always someone looking for barrels spring pins bolts and such. Can turn in or destroy the other Serialized item if you so choose to. I had a newly prohibited registered pistol by name with a Serialized upper reciever in my case had no problems parting it out. Luckily I broke even selling all the parts pretty much.

There's no requirement to turn in, only to report.

If you really had to, sawing the receiver in half would suffice as "destroyed". No other parts need to be destroyed. Not sure how on earth it could be argued that "sawed in half" isn't destroyed.

Receivers aren't complex parts anyways.

They generally they do not have the time or resources to attend in person for matters like this, so most of the time the response you receive will be by email. I learned this firsthand years ago when Bill C‑68 came into effect. At the time, I had two AK‑47 war new relics wrapped and still in the create from the Vietnam war that had been stored away for decades. When the legislation changed, the RCMP arrived with the appropriate paperwork, and all that was required was a sign‑off so the items could be legally exported. Unfortunately, the situation became unnecessarily complicated, and in the end I destroyed them myself, which resulted in a loss of approximately $50,000. It was a costly lesson learned. So just work in the system or do you and join the militia fractions that are starting up that i do not agree with.

Detention centres are filled just as much as actual jails are. The court system is phoney bologna.

So it doesn’t seem like they’ll decide jail time for everyone. Besides many police stations have said they aren’t going to participate.

I honestly, just want peace of mind . Life is difficult as it is.

$7K alone can pay off my student loans, That could take me across the globe for a month on a work sabbatical.
