This hypothetical person probably doesn’t want to be the test case where the courts decide what the answer to this is. This hypothetical person might be able to make some convincing arguments, but I certainly wouldn’t risk it. To the extent that the safe was “specifically constructed or modified for the secure storage of restricted firearms”, I think that stopped being the case when its lock was destroyed. At the very least, this hypothetical person will probably want to take out some firearms legal defence insurance.
