Application / Regulation advice Need some advice from experienced Canadian gun owners
Hey all ! I recently inherited 3 guns. Absolutely no judgement to any legal gun owners out there! It’s just not for me and I would love any advice on what my legal obligations are before I give them away. I know I need to have them registered first before I do anything else. Correct me if I’m wrong, but I understand registration is for the gun itself, whereas license is for the person. Therefore I don’t need a license since I don’t intend on using them….is this correct? Once I register, do I need to do sometime else? For example, do I need to “de-activate” them ? FYI, they are from the early 1900s. They are not considered antiques according to Canadian law. Thanks for the advice fellow Canadians !

You don’t need to register them, if they’re not restricted firearms. You also can’t be in possession of firearms if you don’t have a PAL/RPAL.

You can possess without a license if you're inheriting them and intend to not keep them.

Wrong. Only the Executor of an estate can legally possess firearms without a licence.
In this case, the executor should honor the wishes of an inheritor if they don't want to get a PAL to possess them. Deactivate or sell.

We don’t want the executioner to get the guns. Maybe the executor should hold on to them for now and find someone to legally take them?

You didn’t know it, because it’s not true. You cannot take possession of firearms without a valid licence.

Which is correct, kind of. NAL, not advice.
But as part of the estate, the executor does not own them. The estate does. And if the estate says to pass them to cousin Vinny who has their pal, who do you think gives it to them? A stork?
No it’s the executor that does. So yes, the executor, can “kind of” own them.
But they sure as hell CANNOT USE THEM.

Depends on what province, if you’re outside Quebec and assuming they’re non restricted from their age, no registration is required.
How you get rid of them also depends on your own status. Do you have a PAL, or was this inheritance part of someone’s passing? I believe you are given the temporary powers of a PAL when dealing with an estate, depends on if you were named as an executor.
Fastest and easiest way would be a police non emergency line call to dispose of them at a station (assuming you hold these legally), but it would be better to sell them to another owner who can enjoy them, rather than be destroyed

Yes, it’s due to a passing. And the rcmp confirmed that I’m temporary legally allowed to possess them as the heir. I definitely don’t want to throw them away. I’ll give them but I think I need to register them first …I’m in Quebec

This is a significant detail. You have already dealt in the RCMP, so I suggest going back to them for advice before taking any further action.

The RCMP/CFP can only help with federal rules. It seems like OP is in the clear federally, judging by the reply.
It's the SQ that runs the Quebec LGR (SIAF) so OP has to ask them instead.

Mes condoléances. Je suis aussi du Québec et en général la personne qui possédait originalement les armes à feux les a probablement enregistrées avec la sûreté du Québec. Quant à les donner, je suis sur que plusieurs d’entre nous ici seront plus que près de payer les coûts de livraison ou autre, mais je ne sait pas à quel point ce serait légal de les envoyer en dehors de la province donc fait attention à ça. Quand tu les transportera, assure toi que ce soit fait dans un sac ou case d’arme à feu barré pour t’éviter le trouble.

Registration is not required for most firearms, don't worry about that.
Licensing is indeed for the person, however is it required even for possession.
Deactivation is not required, unless you do not intend to get a license or otherwise keep them without a license.
Options for your are pretty simple:
1: get a license and keep them.
2: pay a gunsmith to deactivate them.
3: sell them to a store or licensed gun owner.
4: hand them in to the police for destruction (make sure you call first, they don't like people just wandering in while armed)

Also note it is honorable you are working to follow the rules. Not always easy. Hope they find a good home and continue to be loved even as a decoration, its a piece of history and whomever you got them from likely had some good stories to go along with them.

It would be helpful to know what type of guns they are, they could fall into three categories. Non restricted (no need to register them), restricted (registered) and prohibited. If they are non restricted all you need to do is verify the license of the individual you are giving them to. Post pics of them so we know what we’re dealing with.

Are they handguns? I'm asking because currently handguns can't be transferred to individuals without rare exceptions, so if they are, and you are trying to sell them, you'll probably have to find a business willing to buy them or try to sell them in the US via an exporter/importer.
(also if they are handguns, you generally would not be able to keep them even if you wanted).

Question 1: what kind of firearms are they? If they are non-restricted, you do not need to register them or anything (UNLESS you are in Quebec) however if you plan on keeping them you do require a PAL. Assuming you are the executor of the will, you do not need to have a PAL during the period of you holding them till you figure out what you are doing with them.
If they are restricted you do, however if you are the executor that MAY give some Lee-way, I don’t know about that part specifically.
Suggestion: if you are truly not going to keep them, I wouldn’t recommend deactivating them no matter what they are, as you can sell them domestically if they are not prohibited and export them if they are. Depending on what they are you could get quite a lot of money. If you are set on not keeping them, and one of them is in fact prohibited (or a restricted pistol as they have issued a transfer freeze) you will need to find either an individual whom is exempt/has grandfather privileges, or a business or auction house licensed to buy them off you or sell them on your behalf may it be domestic or international and will find the buyer for you. An example of such a business would be “Everything Old and Antique” (a store located in BC that iv bought and sold too before that’s licensed for anything) or “Switzers Auctions” (an auction house located in Canada iv bought off of before and is licensed for anything).
Now if you read this far, it would be awesome if you could update this post with what the firearms are or add pictures if you don’t know and we would all be more then happy to help you identify and let you know the classification they fall under. Cheers!

No need to apologize, What sort of judgement could one have about legal firearms owners anyways? In regards to the firearms , Do they have sentimental value to you? Are you going to regret getting rid of them? I believe you can give them away or sell them if you follow the legal processes or speak with the police about having them destroyed.

You don’t have to register them but you need a license to own them, house them, sell them, transfer them, carry them, etc.

Are you the executer or just the person receiving them? The executer is the one that takes care of the transfer I believe. Unless you are in Quebec there is no firearms registry. If you wish to keep them and they are not prohibited you will need to get your PAL. Best bet would be to contact a lawyer.

Registration Depends on if they are non-restricted or not. Generally speaking typical long guns like rifles and shotguns are non restricted. If you legally own the property as inherited property you can simply sell or give them to any appropriately licensed person. Handguns are registered and need to be transferred appropriately to their new owner.
I am being overly simple - please consult this for FAQ.

indicate your province, there is no canada wide registration of non-restricted. You absolutly need a license if you intent to keep them.

If they're still considered non restricted they dont need to be registered unless you live in Queerbec. Get your PAL, sell them to another PAL. Easy peasy.

My opinion? Sell them if you don't wish to keep them.
Most people here aren't "just destroy them" types, so let said guns go to someone who can appreciate or use them properly.
Short term? Keep them hidden, locked up, ammo very separate from the guns, etc. Just stuff to keep them safe and sound.
