Application / Regulation advice What do I do? URGENT

Someone in my household was recently falsely accused of sexual assault. As part of their bail conditions, they are prohibited from possessing firearms, crossbows, and other weapons.

I own three recently prohibited firearms in my collection. Their lawyer has advised that the bail conditions may be considered breached simply because the firearms are in the home. Hopefully, the lawyer can have that condition clarified or amended. If not, I’ll need to transport the firearms to a trusted friend for storage.

What is the process for obtaining an Authorization to Transport (ATT/ATP) for recently prohibited firearms? Is it still possible to get one? I’d rather not participate in the buyback program.

Are they in a safe? Does the member in your household - not you I assume - have access to the safe?

No they don’t have access but since its still in the same household they legally possess them.

Factually incorrect.

If they do not have keys or codes to open the safe, they are not in possession.

Also, time for a general PSA: if your spouse or anyone else in the household do have access to your firearms, they must have the relevant PAL/RPAL.

YOU could be charged for unsafe storage, and THEY vould be charged with unlawful possession. It is strongly recommended that firearms not be stored in the same safe as stuff like passports, wills, or jewlery. If any unlicensed person has a key or combo, you and they are both in legal jeopardy.
