As I told you yesterday it is printed right on the form:

A reference is anyone who has known you for at least three (3) years and is at least 18 years old. However, he or she cannot be your current conjugal partner.

That is it. That is the only requirement.

And I did... what I was asking wasn't a question of legality but a question on their decision making, I don't see how this is being misinterpreted

It’s all good I think as long as your bro isn’t a criminal etc . From what I have read on here the references are rarely contacted but yes can be your brother etc .
