My understanding is that you have a legal right to confront a thief (see Lucky Moose incident)
It might be possible that he confronted the thieves and they tried to rush him. If I am in legal possession of a firearm, and somebody rushes me, I think it is prudent to assume that my life is in danger; I would assume they are going to take my firearm and kill me.
If a jury agrees that my life is in danger, then I have a legal right to self defense.
That is probably not what happened here, but also we don't have the whole story.
