FYI, air rifles are considered firearms when used in crime/for charges. They are only federally deemed non-firearms for transfer, storage, transportation, discharge, etc.

Specifically, they are only considered non-firearms for the purpose of the Criminal Code sections 91 to 95, 99 to 101, 103 to 107 and 117.03, plus certain provisions in the Firearms Act (storage & transportation, for example). 

Additionally, their discharge might be governed by provincial and municipal bylaws. Certain cities prohibit the use of air guns and crossbows within city borders because they are legally firearms under the bylaw, even if they are exempted federally.

Plain English interpretation from the RCMP: "These air guns are exempt from the specific safe storage, transportation and handling requirements set out in the regulations supporting the Firearms Act. However, the Criminal Code requires that you take reasonable precautions to use, carry, handle, store, transport and ship them in a safe and secure manner."

bad thing when we consider that this prevents us from full access to airsoft guns 🙁

other countries have a max FPS limit, for us the issue is our MINIMUM fps is too high. for example all japanese market airsoft guns are restricted to an fps too low to be legal in canada.

I don't get it? We have access to all airsoft under 500fps, there is no minimum threshold in the law for BB gun's to my knowledge, are airsoft regulated under an other law?

EDIT : I just went to read on it and holy crap it's so dumb. But still anything resembling and passing has a firearm during a crime should be considered such for sentencing.

Yes, the minimum speed limit is a thing because in the 1992-95 gun bans they decided to make "replicas" illegal.

This is incorrect. FPS is measured on import (which is why it takes so long). Japanese GBBR/GBBPs use duster gas, which is way lower pressure than green gas/propane. The spec sheet's FPS is based on using duster gas. The CBSA uses green gas/propane for testing, which results in higher FPS. For models that would have too low FPS even with propane, they're imported with a long internal barrel installed, then swapped back to the stock short one after import by the retailer.

The low minimum does cause issues for AEPs though, which is why you'll never see them for sale in Canada, other than the odd one like an MP7 being marketed as an "AEP" when it's not.

I really don't know why you're saying this, as pretty much every airsoft retailer in the country carries Tokyo Marui GBBPs (hicapas), GBBRs (MWS system rifles), and and NBB pistols without issue.

the minimum fps here is 3xx something. many airsoft guns sold in other markets are below that.

if the fps falls below that limit it's no longer considered a "firearm" and instead becomes a replica firearm - which is prohibited

Examples of laws from other countries are used as a basis for promoting law changes within your own country.

If a law is successful or appears to be successful, it is easier to convince others to adopt it or a similar version of it. In case of Canada we have also made laws mostly out of fear of some of the laws in the U.S.

You can ignore how things are done outside of your own borders but it doesn't mean the influence stops.

As far as charges against criminals yes, but they also include these air guns and plastic toy squirt guns seized in raids in their statistics about gun crimes in Canada

Crossbows actually don't meet the broader Criminal Code definition of "firearms", which is a barrelled weapon from which a projectile can be fired which is capable of causing bodily harm or death. Crossbows also cannot realistically be adapted for use with a barrel - "adaptability" being the catch that converts things like gun parts into "firearms" for Criminal Code purposes. However, they are legally "weapons" in almost all cases, so there are still limits on what you can do with them.

As long as we aren't making stupid policy based on the "surface level" claims, I'm okay with this. When used in commission of a crime, a fake gun is still terrifying, and should be sentenced as such. No easy penalties for idiots doing that. As long as we don't ban airsoft guns for this, I'm okay.

It is no less despicable coming from the cops because it is meant to influence the public into supporting a specific agenda.

Our public institutions need to be re-educated about the imperatives of being:

  1. Factual
  2. Neutral and

Context is important tho. A criminal being in possession of a 12ga shotgun vs a pellet gun is something to distinguish to the general public. Laying out a table full of bb guns that look like rifles and handguns without even disclosing that they are toys anyone over 18 can buy is important.

Otherwise the Karen's see tables like this and freak out.
