Because historically the courts have never been friendly to firearms ownership.
Because the government has done is absolute best to obfuscate the issue.
Because a lot of judges in this country are ideologically captured.
The funny part is, even if the scc rules in our favor. With a majority they can ram an amendment to the firearms act through the house to cook it all anyways.
